Terms and Conditions

These Terms of Service govern the use of our website and apply to both in-store and online purchases. Please read these terms carefully, as they outline key provisions that apply to your transactions. In particular, if you are purchasing as a consumer, specific consumer protection rules will override certain clauses mentioned here.

1.2 Our website is intended for the use of existing and potential customers. By placing an order, you agree to comply with these Terms of Service. We recommend reviewing these terms before making any purchase decisions.

1.3 Your use of this website is subject to the terms outlined below, which may be updated periodically without notice. You acknowledge and agree to be governed by the most recent Terms of Service by using this platform to access and place orders. If you disagree, please do not use our website.

2. Definitions

2.1 "Business Customer" refers to a customer purchasing, not for personal but professional use.

2.2 "Consumer" indicates an individual making a purchase unrelated to business or professional activity.

2.3 "Barcode Printers," “we,” or “us” refers to Barcode Printers, as defined above.

2.4 "Catalog" refers to the range of products and services offered by Barcode Printers.

2.5 "Force Majeure" includes unforeseen events beyond our control, such as natural disasters, government actions, or third-party industrial disputes, that may affect service delivery.

2.6 "Normal Working Hours" are from 9:00 AM to 5:00 PM PST on working days.

2.7 "Working Days" include Monday to Friday, excluding public holidays.

2.8 "Website" or "Open Online" refers to our internet portal, accessible at www.barcodesprint.com.

2.9 "Customer" refers to any business, consumer, or potential buyer of Barcode Printers.

2.10 "User" is an individual accessing Open Online on behalf of a customer.

2.11 "Administrator" designates the individual responsible for managing user access on behalf of the customer.

2.12 "Products" are the items available for sale on Open Online, which can be purchased by customers.

2.13 "Terms of Service" encompass the rules governing the use of the website and the commercial relationship between the customer and Barcode Printers.

3. Orders

3.1 All sales of products ("Products") between Barcode Printers (the “Seller”) and you (the “Customer”) are governed by these terms, regardless of whether orders are placed in writing or electronically. Upon confirmation or order acceptance by the Seller, these Terms of Service become part of a binding contract (the “Sales Agreement”). In case of any discrepancies between the Purchase Order and these Terms, our terms will prevail unless specifically agreed otherwise.

3.2 Orders are subject to availability and acceptance. We reserve the right to reject any order.

3.3 The Customer warrants:

3.3.1 All information provided during the purchase process is accurate and up to date.

3.3.2 The payment method belongs to the customer, or they are authorised to use it, and there are sufficient funds to cover the purchase. We reserve the right to verify payment details before completing any transaction.

3.4 Calls and communications may be recorded for quality and training purposes.

3.5 All orders are subject to credit approval. Should credit status deteriorate, the Seller may terminate the Sales Agreement without liability.

4. Pricing and Taxes

4.1 Prices do not include applicable sales taxes, which will be calculated based on the Customer's location and added to the total during checkout.

4.2 Barcode Printers reserves the right to adjust prices if product specifications change at the request of the customer or if delays caused by the customer impact costs.

5. Order Confirmation and Communication

5.1 You will receive a confirmation email once your order has been placed.

5.2 A second email will confirm our acceptance of your order.

5.3 A dispatch confirmation will be sent along with the tracking information for your shipment.

5.4 The email address you provided during the buying process will be used for all correspondence.

6. Delivery and Risk

6.1 For delivery inquiries, please contact our customer support or call us toll-free at 1 (888) 784 0542. You may also check your order status by logging into your account on our website.

6.2 We promise to deliver by the scheduled date. However, we are not accountable for delays caused by reasons beyond our control, such as courier difficulties or manufacturer delays. Should there be a delay, we will let you know right away. Order cancellation is permitted if the altered delivery date is not acceptable to the customer.

6.3 For business customers, if products are not delivered within 30 days of the agreed date, the customer may cancel the order and request a refund. Cancellation must be submitted in writing before delivery or notice of delivery readiness.

6.4 For Business Customers, any damage or discrepancies in orders must be reported within 48 hours of receipt. Consumers should report issues within a reasonable timeframe.

6.5 Business Customers must ensure that someone is available to accept deliveries during Normal Working Hours.

6.6 Risk transfers to the Customer once the products are dispatched to the carrier. If the customer refuses or cannot accept delivery, the risk still transfers at that point. The Customer is responsible for any storage or associated costs if delivery is delayed.

6.7 Ownership of the Products passes to the Customer once full payment is received.

6.8 In the event of failed delivery, we may store, sell, or reschedule the Products at the Customer’s expense.

6.9 Customers may request proof of delivery within 3 months of the delivery date. After this period, deliveries will be considered complete.

6.10 Upon receipt, the Customer must sign for the delivery and verify that the package count matches the delivery note. Any discrepancies should be noted immediately on the proof of delivery.

7. Delivery Options

7.1 Standard Delivery

Our standard delivery service ensures that you receive your complete order within 3 to 5 business days. This timeline begins once all items in your order are confirmed to be in stock and ready for dispatch.

7.2 Partial Shipments

When ordering multiple items, some may have different lead times. In these cases, you can request separate deliveries for each item. Please be aware that deliveries that go beyond the parameters of regular shipping may incur extra costs.

7.3 Shipping to Multiple Locations

For customers who prefer to make centralised purchases and have items delivered to different offices or locations, this can be arranged after completing the necessary security checks and covering any associated extra costs.

7.4 Nationwide Delivery

We provide delivery services to all states within the United States, typically handled by Federal Express or UPS. Once your order is dispatched, you can expect delivery within a maximum of 2 days. Please be aware that Barcode Printers reserves the right to select the delivery method at its discretion.

7.5 Weekend Deliveries

DHL does not operate weekend deliveries. If you place an order on a Friday and the product is in stock, it will be delivered on the following business day.

8. Product Availability

8.1 We regularly update product availability on our website throughout the day. While we strive to maintain consistent stock levels for all items, we cannot guarantee uninterrupted availability. If your selected item is unavailable, we will promptly inform you of the expected delivery dates. If the product remains out of stock after the indicated waiting period, we will contact you via email or phone to discuss extending the wait time or suggest an alternative product. Even if a product appears “out of stock” on our site, one of our suppliers may still have availability. Please feel free to reach out via phone or email with any inquiries.

9. Payment Methods

9.1 Account Payment

To set up an account payment, please complete our Credit Application Form. Once submitted, our credit department will review your application and assign a credit limit, which may take up to one week. Once approved, you will have terms for payments up to thirty days as long as the credit limit is met.

9.2 Credit and Debit Cards

We accept American Express, Visa, and MasterCard for secure payments. For security purposes, your card will be charged on the day of your order. Payments can be made online or by completing the credit card form.

9.3 Payment Terms

The standard payment term for customers with credit accounts is 30 days from the invoice date. This term applies unless alternative terms are agreed upon in writing for specific transactions. We retain the right to impose daily interest at the rate of 5% annually for consumers and 18% annually for corporate customers on the outstanding balance if payment is not received by the due date.

10. Product Specifications

10.1 Product Representation

We strive to provide products as advertised. If the manufacturer makes adjustments, we do, however, reserve the right to supply items with slight deviations in actual measurements and specifications.

10.2 Substitutions

If we are unable to supply the originally ordered products, we reserve the right to offer products of equal or superior quality at no additional cost. The consumer has the option to cancel the transaction and get a refund for all money paid, including delivery, if they decide not to accept the substitute items that were supplied. This will be the only recourse available to the customer in such circumstances.

11. Trade Names and Trademarks

11.1 Trade Names and Trademarks

Trade names and trademarks (excluding possessive forms) may not consistently indicate the actual producer of a specific product; instead, they may suggest commonly used systems and machinery associated with these products.

11.2 Verification of Manufacturer

Customers intending to procure a specific brand of product should verify the manufacturer’s identity for the component they plan to acquire before finalizing their order.

12. Warranty and Return Policy

12.1 Commitment to Quality

We are committed to providing high-quality products and services to our valued customers. However, in rare instances, products may exhibit faults or defects. In such cases, we offer the following return procedures:

12.2 Manufacturer’s Warranty

Unless otherwise specified in the manufacturer’s documentation, all delivered products come with a 12-month manufacturer’s warranty.

12.3 Exclusions for Business Purchases

For customers purchasing products for their business, the provisions within this clause apply. To the extent allowed by law, all additional conditions and implied guarantees pertaining to product delivery are excluded, with the exception of the express terms stated in these conditions and Conditions. Unless expressly stated in writing, products are not guaranteed to be suitable for use in certain situations or applications.

12.4 Service Warranty

We commit to performing services at industry standard and warrant our work to be free from defects for 30 days. We are not liable for faults or damage not caused by our service engineers. We reserve the right to appoint an independent expert for claims regarding skill and judgment. We are not responsible for equipment altered by parties other than us. All other terms or warranties related to the services are excluded.

12.5 Omitted Section

12.6 Returns of Unwanted Products

Products returned within 7 days of delivery with our prior written approval are required if we agree to accept returns of undesired items for reimbursement. The products must remain unopened and in perfect, resalable condition. A handling fee of 25% of the sale price will apply in such cases.

12.7 Returns of Defective Products

If a product is found to be faulty, you can return it to us within seven days of delivery for a full refund or replacement, pending the verification of any stated issue.

12.8 Technical Support Guidance

Our technical support or customer support team will guide you on the preferred return method. Depending on the type of goods you bought, we will either ask you to return it to us directly or set up a courier pickup. If the products are deemed defective upon inspection, we will refund the return shipping cost.

12.9 No Charge Collection

We offer a “no charge” collection, repair, and delivery service for Barcode Printers proven to be faulty, provided the fault is reported within 7 days of delivery. If we schedule a courier collection, someone must be present at the collection address when the courier arrives.

12.10 Returns Material Authorization (RMA)

An RMA Number, or Returns Material Authorization, is required for any returned merchandise. This number may be acquired by calling customer service at (855) 433 8818. Products returned without an RMA number won't be accepted. Attach the RMA number to the supplied address label rather than writing directly on the manufacturer's package. Any damage to the manufacturer’s packaging or inadequate packaging may result in the rejection of the return or an additional restocking fee at our discretion.

12.11 Liability for Transit Damage

We cannot be held liable for packages damaged during transit. The customer is responsible for properly packaging the product to prevent damage.

12.12 Proof of Delivery

Because proof of postage is not evidence of delivery, we strongly advise shipping your shipment by courier, registered post, or recorded delivery and make sure the products are fully insured.

12.13 Fault Testing Process

We will test the returned product to determine the nature of the alleged defect after receiving it.

12.13.1 Return of Non-Defective Products

If the product is found to be in good working order without any defects, we will return the product to you, and you will be responsible for the return carriage costs. If you request a replacement before the testing is completed, you will be liable for the cost of both products.

12.13.2 Warranty Limitations

This guarantee is void if the items have not been used in accordance with manufacturer instructions or if the customer, its employees, or agents have worked on, changed, or damaged the products.

12.13.3 Software Returns

Software with broken seals cannot be returned for credit. The manufacturer will replace faulty software disks. Program licenses cannot be returned unless the physical medium is faulty or the program substantially deviates from the specifications.

12.14 Manufacturer’s Time Limits

Certain manufacturers stipulate that returns must be made within 7 days or fewer in order to be eligible for a refund. The manufacturer's time limit is applicable in these situations. Returns for defective products that do not meet the description must be sent to us within seven days. After this time, you will be considered to have accepted the goods, and it will be your responsibility to check them when you get them. According to clause 15, this limit is

12.15 Exclusivity of Warranty

All other guarantees, including the implied warranties of merchantability and fitness for a specific purpose, are superseded by this one. This represents our sole warranty for the products. We give no warranties concerning performance, manufacture, disposable or wearing parts, or any separately specified product item not specifically covered herein.

13. Liability

13.1 Limitation of Liability

When dealing with business customers, we shall not be held responsible for any consequential or indirect damages or losses, regardless of their cause. This includes but is not restricted to, losses of revenue or business, deterioration of goodwill, damage to commercial relationships, loss of data, and other monetary setbacks. Our liability will be limited to the total invoiced amount for the relevant order, except in cases of faulty products.

13.2 Exemption for Personal Injury

This agreement does not limit our liability in cases where our carelessness causes death or serious personal injury.

14.1 Safety Assurance

We affirm that the products we distribute pose no health and safety risks when (i) used as intended and (ii) consumers adopt reasonable and normal safeguards throughout their use.

15. Force Majeure

15.1 Non-Liability for Force Majeure

If, despite our best efforts, we are unable to fulfil an obligation due to circumstances beyond our control or a force majeure event, we will not be considered in violation of our contract with the customer.

16. Special Rules for Clearance Bargains & Non-Current Catalog Requests (‘NCCR’) Products

16.1 Clearance Sales

Products marked as “Clearance Sales” are discounted items that are in limited supply and are subject to the following special rules. All additional terms and conditions—aside from those that directly concern customers—apply in addition to and, in the event of a disagreement, take precedence over these guidelines.

16.2 Product Condition

Obtaining clearance Products that are sold are classified according to the condition that was stated at the time of sale. The description will specify the duration of any applicable warranty.

16.3 Stock Confirmation for Clearance Products

Orders for Clearance Sale goods are subject to stock confirmation by Barcode Printers due to their limited availability. Payment will not be taken until the customer has received confirmation of stock availability before a sales contract is created.

16.4 Rules for NCCR Products

Along with the standard terms and conditions offered by Barcode Printers, the following specific regulations apply to any items sold as "Specials" or "Non-current catalog requests" (NCCR).

16.5 Non-Returnability of NCCR Products

Except in situations where we have made a mistake or the items are discovered to be defective, these products cannot be returned.

16.6 Validity of Quoted Prices

The listed rates are applicable for a period of 14 days only.

16.7 Discount Eligibility

Quoted prices are not eligible for value, cash, or volume discounts.

17 – Errors and Omissions

17.1) We strive for accuracy in prices and descriptions in our catalog and on our website. However, due to the fast-paced nature of e-commerce, errors may occur. In the event of a significant error or omission, we reserve the right to cancel the contract, even after accepting your order and receiving payment. Our liability is limited to refunding the amount paid. If a pricing error occurs, you may purchase the products by paying the difference between the quoted price and the corrected price confirmed by us.

18 – Customer Responsibilities

18.1) The Customer must designate an "Administrator" for Open Online as specified in the authorization form.

18.2) The Administrator is responsible for using Open Online on behalf of the Customer.

18.3) The Customer can change the Administrator via the online platform or by notifying Limited in writing.

18.4) The client has the responsibility of fulfilling all technological prerequisites for accessing Open Online. Limited is not liable for losses from technical incompatibilities.

18.5) The customer is responsible for making sure that users and their authorised Administrator don't give out login credentials to unaffiliated parties.

19 – Administrator Responsibilities

19.1) The Administrator is required to:

  • 19.1.1) Authorise, approve, and set access levels for Users.
  • 19.1.2) Remove or amend Users who have left the company or are deemed unfit.
  • 19.1.3) Ensure the accuracy of Customer company details stored on Open Online.

19.2) The Customer acknowledges responsibility for the Administrator's actions and any data modifications.

20 – User Responsibilities

20.1) Users must act on behalf of the Customer when using Open Online.

20.2) Users must not disclose security details to third parties.

20.3) Upon termination of employment or representation, Users must not use the Customer’s login information.

21 – Security and Login Information

21.1) Open Online login credentials consist of:

  • 21.1.1) Account Number.
  • 21.1.2) User’s unique Username (usually their email address).
  • 21.1.3) User’s confidential Password (any alphanumeric combination).

21.2) Using the login information signifies the Customer’s consent to orders placed on their behalf.

21.3) The Customer, Administrator, and User must keep login information confidential.

22 – License

22.1) This website may be used, subject to these Terms and Conditions, by non-exclusive license.

22.2) This license may be terminated by us at any time and without prior notice.

22.3) Accessing the website indicates acceptance of these Terms and Conditions.

23 – Website Materials

23.1) All rights to the website’s content are owned or controlled by us. The Content includes the website's design, layout, appearance, and graphics and is protected by intellectual property laws. Any use of the Content for personal, non-commercial use is permitted; all other uses require written permission.

23.2) Distribution or republication of materials on this website to third parties without written consent is prohibited.

23.3) No part of the website may be distributed for commercial purposes without prior written permission.

23.4) Unauthorised use may result in claims for damages or criminal prosecution.

25.1) This website may contain links to other websites. Downloading or obtaining content from external sites is at your own risk; we assume no liability for content on sites we do not control.

25.2) Creating a link to this website from another site requires prior written consent.

26 – Liability

26.1) Unless stated otherwise, we make no warranties or representations concerning the website or its content.

26.2) We do not guarantee compatibility with all hardware and software.

26.3) We are not liable for any direct, indirect, or consequential loss related to the use of this website.

27 – Alterations To The Website's Content

28 – Viruses & Malfunctioning Programs

29 – User Conduct Regarding Our Security & Privacy

29.1) You agree not to:

31 – Repair Service

31.1) We are not liable for any loss of business or other losses, actions, costs, claims, consequential damages, expenses, or liabilities resulting from direct or indirect claims made against us or our customers arising from our repair services or delays in product delivery.

31.2) No Fix, No Fee Policy: We won't bill the client (shipping fees excluded) if we are unable to fix the items. A testing fee may apply upon request.

31.3) We commit to making reasonable efforts to service or repair products and address reported faults to the best of our abilities.

31.4) We may give estimates for a testing service without repairs for clients who have several devices in an unclear state. Once the testing reports are available, customers may request separate repair quotes.

31.5) Repair cost estimates will be based on the information available at the time of the quote request. If, upon inspection, it becomes infeasible to repair within the agreed cost, an "uplift" in repair price may be necessary. We will communicate the reasons for any price adjustments. The equipment will be returned as "Beyond Economical Repair" at no additional cost (except for shipping expenses) if the client refuses the upgrade. Test results will be charged at the test rate if requested.

31.6) We reserve the right to classify products as “Beyond Repair.”

31.7) Repair timelines will depend on the availability of necessary parts.

31.8) We shall notify the customer as soon as possible and assume no responsibility for any delays that may arise if items need to be held due to component availability or other circumstances.

31.9) During the inspection, if the cost of required parts exceeds the initial repair price, the additional cost may be passed on as an “uplift.” We will order these parts only after receiving confirmation from the customer to accept the adjusted price. If the uplift is declined, the products will be returned as “Beyond Economical Repair” at no extra cost (excluding shipping fees).

31.10) Parts used for repairs may be new or refurbished, fulfilling manufacturer requirements and functionality comparable to new parts.

31.11) Before delivering the items to us, customers are in charge of backing up or deleting any data or configuration that may have been kept on them.

31.12) All data/configuration will be erased as part of the standard repair process.

31.13) We are not responsible for any loss, deletion, or inaccessibility of data stored on the products.

31.14) We do not guarantee upgrades to the "latest" software version due to copyright and licensing constraints.

31.15) Upgrading or downgrading products may be necessary due to compatibility issues. We will seek customer approval for any associated licensing costs.

31.16) Customers are responsible for making sure that all items arrive with the necessary internal and external memory, flash, and flash cards."Reference" pieces will be used to evaluate incomplete items; these parts will be taken out prior to return.

31.17) Warranty does not cover products found faulty due to missing memory/flash/flash cards.

31.18) Software problems are not covered by warranties and will require payment for the entire cost of repairs.

31.19) We offer a 12-month guarantee on the repair alone, not the complete appliance.

31.20) Within the warranty term, written warranty claims must be made using our usual RMA method, citing the serial number (see condition 11).

31.21) It is essential that the items' transportation to and from our repair facility be covered by the customer's insurance. We will notify customers within 48 hours of any damage to products received.

31.22) During the inspection, if products are found with "No Fault Found" (NFF), we will send courtesy communications requesting further information if necessary.

31.23) If there is no response regarding an NFF resolution after ten days, We will charge the entire repair cost upon receiving the items back as NFF.

31.24) All items undergo a minimum soak test time of 2 hours unless an intermittent defect is anticipated, in which case the soak test may extend up to 5 days.

31.25). The conditions of the warranty may be impacted if a consumer requests the items' return right away during the prolonged soak test. We will inform the customer if turnaround time is impacted.

31.26) Repaired products will be returned within five working days from the inspection date. We will promptly notify the customer in case of unforeseen delays.

31.27). When feasible, customers should offer specifics about the alleged issue, as failure to do so may impact the quote and turnaround time.

31.28) We will provide diagnostic/test reports generated from repaired products when feasible. We may not, however, disclose the precise repair procedures or the parts that were changed in order to preserve our intellectual property.

31.29) Customers are responsible for transportation costs for sending products to and from their location. Transport costs will be invoiced regardless of whether services are accepted.

31.30) Products need to be wrapped carefully to avoid electrostatic discharge and physical damage.

31.31). When it comes to chassis-based goods, all modules ought to be taken out unless specifically included in the purchase order for inspection or maintenance.

32 – General

32.1) These Terms and Conditions do not affect your statutory rights as a consumer.

32.2) This Agreement's provisions will be severed without affecting the other terms in the event that any of them are found to be invalid or unenforceable.

32.3) Any waiver of a breach must be documented in writing. All previous communications between the parties about this subject matter are superseded by these Terms and Conditions, which serve as the whole agreement.

Modifications can only be made through written agreements signed by authorized representatives.

32.4) Any conflicting or extra terms included in a purchase order or other papers issued by either party are superseded by these terms and conditions.

32.5) Any changes to this agreement need to be submitted in writing and approved by a representative.

32.6) Headings are for convenience only and shall not impact the interpretation of this Agreement.

32.7) Notices under this Agreement must be in writing and delivered via (i) first-class pre-paid post to the last known address, (ii) fax to the last known fax number, or (iii) email to the last notified email address.
